Welcome to the Sweetmyo® website, sweetmyo.com (the “Site”), and the Sweetmyo mobile application (the “App,” and together with the Site, the “Services”). The Services are operated by Sweetmyo (“Sweetmyo,” “we,” “us,” or “our”). Each person who accesses and/or uses the Services (each a “User,” “you,” or “your”) should please read these Terms of Service (“Terms”) carefully before using the Services. By accessing or using any part of the Services, you signify that you have read, understand, and agree to be bound by these Terms, regardless of whether you are a registered user of the Site or the App. If you do not agree to these Terms, please do not use the Services.

1. ELIGIBILITY & WELLNESS INTENDED USE

Sweetmyo products and services are intended solely for adult users (18+). Sweetmyo products are consumer wellness and fitness devices, not medical devices, and are not intended to diagnose, treat, cure, or prevent any disease. You represent and warrant that: You are legally capable of entering into a binding agreement; You will use the Services only for lawful personal or permitted commercial purposes; You will follow all safety instructions and warnings provided by Sweetmyo.

2. HEALTH & SAFETY RESPONSIBILITY

Bio-electrical active conditioning involves physical exertion and 2000Hz carrier wave micro-impulses applied to the body across up to 12 conductive fabric nodes. You acknowledge and agree that: Use of the product is at your own risk; You are solely responsible for determining whether bio-electrical signal conditioning is suitable for you; You should consult a qualified healthcare professional before use if you have medical conditions, implanted electronic devices (such as cardiac pacemakers), active inflammation, skin lesions, or health concerns. Sweetmyo is not responsible for injuries, discomfort, skin irritation, misuse, or improper operation of the product.

3. ACCOUNTS AND APP USAGE

Some features require account creation within the Sweetmyo App. You are responsible for: Maintaining the confidentiality of your account credentials; All activities conducted under your account; Ensuring the accuracy of information provided. Sweetmyo reserves the right to suspend or terminate accounts for violations of these Terms or misuse of the Services.

4. SOFTWARE, UPDATES, AND CONNECTIVITY

The Sweetmyo App and STRATA® Hub may require: Compatible mobile devices (iOS / Android); Bluetooth Low Energy (BLE 5.0) connectivity; Periodic Over-The-Air (OTA) firmware updates for the STRATA Hub and app software updates. We do not guarantee uninterrupted or error-free operation. Features, signal mapping algorithms, and software interfaces may change, be modified, or discontinued without notice.

5. SUBSCRIPTIONS AND PAID FEATURES

Certain advanced AI conditioning algorithms and specialized tracking features within the App may require a paid subscription. Key terms: Subscriptions are billed on a recurring basis unless canceled; Fees, billing cycles, and trial terms are disclosed at purchase; Subscriptions are optional; core device hardware functionality and standard preset modes remain available without subscription. All payments are handled through third-party platforms (e.g., App Store, Google Play, Shopify). Refunds are subject to the policies of the original payment provider.

6. ORDERS, SHIPPING, AND RETURNS

Physical product purchases (including the Gen1 System, 5000mAh STRATA Hub, and accessory cables) are subject to: Product availability; Manufacturing and logistics constraints; Shipping timelines disclosed at purchase or via updates; Customization Fees: Bespoke sizing, custom configurations, or specialized modifications require additional fees and extended processing times. Return and refund eligibility is governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Used, worn, or activated products may not be eligible for return outside of explicitly stated trial terms.

7. INTELLECTUAL PROPERTY

All content, software, 2000Hz signal algorithms, industrial designs, suit contours, trademarks, logos, and materials are the exclusive property of Sweetmyo or its licensors. You may not: Copy, modify, distribute, reverse engineer, decompile, or exploit any part of the hardware, app, or Services; Use Sweetmyo branding without written permission.

8. PROHIBITED CONDUCT

You agree not to: Misuse or attempt to disrupt the Services or alter hardware safety voltage limits; Circumvent security or technical restrictions; Use the Services for unlawful, abusive, or fraudulent purposes; Resell or commercially exploit the Services or hardware without authorization.

9. THIRD-PARTY SERVICES

The Services may integrate or link to third-party platforms. Sweetmyo is not responsible for: Third-party content, services, or policies; Payment processors, app stores, or logistics providers. Your use of third-party services is governed by their own terms.

10. DISCLAIMER OF WARRANTIES

The Services are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, Sweetmyo disclaims all warranties, express or implied, including: Merchantability; Fitness for a particular purpose; Non-infringement.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Sweetmyo from any claims, damages, liabilities, or expenses arising from: Your misuse of the Services or hardware; Violation of these Terms; Violation of applicable laws or third-party rights.

12. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of HK.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
